Terms & conditions

1.General:
Without prejudice to the applicability of any special conditions that prevail at present general conditions, all sales, supplies and services are covered under the following general terms and conditions. These general conditions prevail over those of the buyers. The payment of goods includes the acceptance of these general terms and conditions.

 2.Prices:
All prices are quoted in EURO (€ 00,00) and shipping is excluded on the website. Unless otherwise mentioned all goods are margin goods (second hand goods), therefor special VAT legislation is applicable. VAT on margin goods can not be deducted and is therefore never mentioned in our prices. For export: prices do not include VAT or Duty taxes.

3.Payment:
Payments can be made by:

  • In our depot all payments are in cash;

  • Prior to the delivery of goods by bank wire transfer (see for bank details the information on the invoice) 

  • Payment by credit card is accepted but the bank charges would be for the account of the buyer (1,9%) 

4.Acceptance:
Our goods are considered as sold as soon as we have send our invoice and have received your payment. Unless otherwise stated the buyer agrees to collect the goods within 14 days or to accept within the agreed terms of delivery/pick up, following on the date on which we received the payment. If the goods are not collected within 14 days, unless otherwise agreed, FOUND ICONS charges a storage fee of 10% of the total purchased price per week.

Our products are second-hand: no guarantee is provided. In order to inspect the condition of the goods, we can provide on-site viewing or upon request we can provide additional photos and/or videos. Lamps and other electric products will be checked and repaired before they are offered on the website. Nevertheless, we recommend you to consult a licensed electrician before using.

FOUND ICONS can not be held liable for any damages or injuries resulting from the use of these products. Acceptance of the goods implies the approval of the state of the goods.

5.Cancellation:
The buyer has the right to cancel the order and request for a refund of the paid invoice.  The buyer may cancel the order for free, within 24 hours of payment made, no questions asked. After 24 hours, the cancellation will be considered a return, and the buyer will have to abide by the terms of the item return policy, costs made to arrange a shipment will be deducted from the refund and we will charge a 10% restocking fee for the item(s).

If the buyer requested a later delivery when placing the order and decides during this storage period to cancel the order, we charge a 10% restocking fee for every week we’ve stored the item(s) calculated from the payment date until the request for cancellation, to a maximum of the (paid) item price , plus any shipping and/or logistic costs that have already been made.

Please note that custom and made-to-order items are not eligible for cancellation once the order has been placed, with the exception of the first 24 hours.

6.Return Policy:
The buyer has the right to refrain from purchasing goods within the statutory period of 14 days after receiving the items. Notification for return must be made by registered post or by email. Costs for delivery and return are never refunded, only the purchased item price. Goods returned are transported at the cost and risk of the buyer.

7.Shipments:
Shipments are sent within 5 working days upon receipt of payment in our account. All goods are professionally packed with protective materials.

8.Delivery:
The delivery deadlines are specified. FOUND ICONS cannot be held liable for any potential delivery problems that may arise by external carriers.  Complaints regarding delivery must be made by registered post or email within 5 days after the delivery date.

 9.Insurance:
All goods shipped by us are insured from depot to clients address against loss and breakage. If a claim procedure is started, FOUND ICONS is entitled to provide data on the involved individual(s) to the relevant insurer or insurance party.

 10.Claims:
Although every effort will be made in order to secure safe arrival of goods at destination, it may happen that goods are missing or damaged upon delivery. It is important to check the goods at delivery. We strongly advise to sign the receipt for delivery in good order after you checked the goods by opening the package/parcel. If you see something strange sign the receipt with ‘damaged goods’ and contact us immediately. Damages or complaints with the courier company must be sent to us by email or in registered post within 5 working days after delivery.

In case of defect, please send your complaint in writing, within 5 working days after delivery, stating:

  1. a) Description of defective part;

    b) Copy of your invoice, showing purchase of the article;

    c) Pictures of the defect;

    d) Pictures of the packing material, with at least 1 picture with the shipment label in sight.

On receipt of your complaint, we will start the necessary claim procedure with the shipping company. In case of transport damage we’ll discuss the following options with you: either we cover the costs for repair (if possible and if you still would like to keep the item) or you’ll get a full refund of your purchase (including shipping costs) and we retrieve the piece(s) if we think we can restore the item again, or if requested by the insurance company.

Claims should be made within 5 working days after delivery. Claims made after this period are no longer valid, and are no longer covered.

11.Guarantee:
All items are vintage design items, therefore we can not offer a guarantee on our products.

The invoice of the item is your official paper for your insurance, in case this is needed.

In case of shipment defects see above procedure (9).

12.Pricing of goods:
The prices of goods on our online platform prevail over prices mentioned elsewhere, due to the expiration date of (online) offers, typing errors or the different sales methods of external platforms. Only after we send you our offer in writing or we confirm the (online) mentioned price, the offer made is valid and binding. An offer always expires after the mentioned expiration date or, if no expiration date is mentioned, it will expire after 7 days. No rights can be derived from expired offers or offers on external platform.

13.Privacy Statement:

We hereby refer to our Privacy Statement. Read this carefully, so that you understand how we process your data and what your rights are. By paying our invoice you agree that FOUND ICONS, for the purpose of the contractual obligation described in this invoice, shares your basic data (address and telephone number) to the carrier or supplier who will deliver your purchases (or parts thereof). Found Icons is obliged to keep track of which third parties have received your data, but is not responsible and liable for the further management and handling of your personal data by the companies concerned.

14.Jurisdiction:
The contract is subject to the Dutch Law.
